This Privacy Policy explains how Malva Innovations LLC (“BOATERA,” “we,” “us,” or “our”) collects, uses, and shares information when you use the BOATERA website, platform, Marlow AI copilot, and related services (the “Service”).
1. Information We Collect
Information you provide
- Account information: name, email address, login credentials, preferences, membership status, and Founding Member number.
- Boat information: boat details, engine hours, maintenance and service history, expenses, reminders, notes, and related records.
- Documents and uploads: receipts, invoices, photographs, registration or insurance documents, and other files you choose to store.
- Marlow content: questions, prompts, responses, and relevant account information used to generate an answer.
- Communications: support requests, feedback, surveys, and other messages you send us.
Please do not upload information you are not authorized to provide or highly sensitive information that is unnecessary for the Service.
Payment information
Payments are processed by our payment provider. We may receive transaction details such as the amount, date, payment status, and a limited payment-method identifier, but we do not intend to store complete payment-card numbers or security codes.
Information collected automatically
We and our providers may collect IP address, browser and device information, pages and features used, dates and times of access, diagnostics, crash data, and cookie or similar technology information. We use this information to operate, secure, understand, and improve the Service.
2. How We Use Information
- Create, maintain, and secure your account.
- Provide boat-record, maintenance, service-history, engine-hour, document, expense, and reminder features.
- Process Marlow questions and generate responses.
- Process purchases and administer memberships.
- Send account messages, requested reminders, support replies, and product updates.
- Diagnose problems, improve the Service, and understand feature usage.
- Detect fraud, abuse, unauthorized access, and security issues.
- Comply with legal obligations and enforce our Terms of Service.
We may also create aggregated or de-identified information that does not reasonably identify you and use it for lawful business purposes.
3. Marlow and AI Processing
Marlow uses AI to help retrieve and summarize information available in your BOATERA account. To answer a question, we may send your prompt and relevant account context to our AI processing providers, which process that information to provide the requested response.
Marlow may produce incomplete or inaccurate information. Check important answers against your original records and appropriate professional or manufacturer guidance. Do not submit information to Marlow that you do not want processed by BOATERA and its AI providers.
4. How We Share Information
- Service providers that support hosting, storage, authentication, payments, email, analytics, customer support, security, and AI processing.
- Third parties you direct us to use when you enable a sharing feature or integration.
- Authorities or other parties for legal and safety reasons when required by law or reasonably necessary to protect rights, safety, accounts, or the Service.
- Parties to a business transaction involving a merger, financing, acquisition, reorganization, or sale of assets.
5. Cookies and Analytics
We may use cookies, local storage, pixels, and similar technologies for authentication, preferences, security, analytics, and advertising attribution. Where required, we will request consent before using non-essential technologies. You can manage available choices through your browser, although blocking required cookies may prevent parts of the Service from working.
6. Data Retention and Deletion
We keep information for as long as your account is active and as reasonably needed to provide the Service, complete transactions, comply with law, prevent fraud, resolve disputes, and enforce agreements.
If you close your account or submit an eligible deletion request, we will delete or de-identify account information according to our procedures, subject to legal, security, transaction, and backup requirements.
7. Security and Backups
We use reasonable administrative, technical, and organizational measures designed to protect information. No online service can guarantee complete security.
You are responsible for protecting your login credentials and devices. BOATERA should not be the only place you keep critical documents or records that you are required to retain. Maintain independent copies of important information.
8. Your Choices and Rights
Depending on where you live, you may have rights to access, correct, export, delete, restrict, or object to certain uses of personal information. To submit a request, email support@boatera.app with the subject Privacy Request. We may need to verify your identity before completing the request.
You may unsubscribe from promotional emails using the link in the message. We may still send essential account, transaction, security, and policy communications.
9. Children’s Privacy
The Service is not directed to anyone under 18, and we do not knowingly permit children under 18 to create accounts. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.
10. International Users
BOATERA and its providers may process information in countries other than the country where you live, including the United States. Those countries may have different privacy laws.
11. Third-Party Services
BOATERA may link to or integrate with third-party services. Their privacy practices are governed by their own policies, and we are not responsible for those practices.
12. Changes to This Policy
We may update this Privacy Policy as the Service or our practices change. We will post the revised policy and update the date above. We will provide additional notice of material changes where required.
