Terms of Service

These Terms of Service (“Terms”) govern your use of the BOATERA website, platform, Marlow AI copilot, and related services (the “Service”). BOATERA is operated by Malva Innovations LLC (“BOATERA,” “we,” “us,” or “our”). By creating an account, purchasing a membership, or using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy.
1. Eligibility and Accounts
You must be at least 18 years old and able to enter a binding agreement. You are responsible for providing accurate account information, protecting your login credentials and devices, and all activity under your account. Notify support@boatera.app promptly if you suspect unauthorized access.
2. The Service
BOATERA is a mobile-first web platform for recreational boat owners. It may allow you to organize boat information, engine hours, maintenance and service history, documents, expenses, reminders, and related records, and to ask Marlow questions about information stored in your account.
At launch, each membership supports one boat. Multi-boat support may be offered later, but no release date, pricing, or automatic inclusion is promised.
We may add, modify, test, suspend, or discontinue features. Future native applications, integrations, multi-boat support, or other capabilities are not included unless expressly stated in a written offer.
3. Your Content
You retain ownership of information and files you submit to BOATERA (“User Content”). You give us a limited, non-exclusive license to host, store, process, display, and transmit User Content as reasonably necessary to provide, secure, support, and improve the Service and to comply with law.
You are responsible for the accuracy and legality of User Content and for having the right to upload it. Do not upload another person’s confidential information without authorization or highly sensitive information that is unnecessary for the Service.
Keep independent copies of critical boat documents and records. BOATERA should not be your only legally or operationally required archive.
4. Marlow and AI-Generated Information
Marlow is an AI-assisted feature that uses information available in your account to retrieve, summarize, or generate responses. AI output may be incomplete, inaccurate, or outdated. You must verify important information against original records, manufacturer guidance, and qualified professionals.
Marlow is not a mechanic, marine technician, surveyor, navigator, weather service, emergency service, insurer, attorney, accountant, or substitute for professional judgment. Do not use BOATERA or Marlow as the sole basis for maintenance, seaworthiness, navigation, safety, insurance, financial, legal, or emergency decisions.
Marlow may be subject to reasonable rate limits, technical limits, and fair-use rules so that lifetime access remains sustainable. Any applicable limits will be described in your account or at checkout.
5. Memberships and Payment
Prices and included features are displayed at checkout. You authorize BOATERA and its payment provider to charge the disclosed amount and applicable taxes using your selected payment method.
When public subscription plans are available, monthly and annual memberships will renew automatically unless cancelled before the next renewal date. The current planned public price is $19.99 per month or $180 per year, but the amount displayed at checkout controls.
You may cancel by emailing support@boatera.app. Cancellation prevents future renewal charges and normally takes effect at the end of the paid billing period.
6. Founding Membership and Lifetime Access
The Founding Membership is a limited offer available to no more than 200 members for a $97 one-time payment, subject to the complete offer shown at checkout.
If the offer states “$0 monthly fees for life” or “lifetime access,” it means access to the BOATERA core membership for the commercial life of the Service while your account remains active, in good standing, and compliant with these Terms. It does not guarantee that BOATERA will operate indefinitely or that every current or future feature will always be included.
Unless expressly stated otherwise, lifetime access does not automatically include future multi-boat plans, third-party services, premium integrations, concierge work, unusually high storage, premium AI models, usage above Marlow’s fair-use limits, or separate future products.
Founding Memberships and Founding Member numbers are personal to the original purchaser and may not be transferred without our written approval.
7. Refunds
Eligible initial purchases are covered by the BOATERA 30-day money-back guarantee described in our Refund Policy. When a Founding purchase is refunded, the membership, lifetime-access benefit, Founding Member number or status, and associated paid access end.
8. Acceptable Use
You may not use the Service to violate law or another person’s rights; upload content you do not have permission to use; access another account without authorization; introduce malware; interfere with security or usage limits; scrape or overload the Service; reverse engineer or resell the Service; abuse refunds or payments; or use Marlow for unlawful, harmful, fraudulent, deceptive, or abusive activity.
We may investigate violations and remove content, limit use, suspend accounts, or terminate access where reasonably necessary.
9. Third-Party Services
The Service may rely on third-party providers for payments, hosting, storage, email, analytics, authentication, and AI processing. We do not control third-party services, and their own terms and privacy policies may apply.
10. Intellectual Property and Feedback
BOATERA and its licensors own the Service, software, branding, interfaces, and content we provide, excluding User Content. We grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.
If you send us ideas or feedback, you allow us to use them without restriction or compensation. This does not transfer ownership of your private boat records.
11. Suspension, Termination, and Changes
You may stop using the Service and request account closure by emailing support@boatera.app.
We may suspend or terminate access for nonpayment, a material violation of these Terms, fraud, abuse, security risk, or unlawful use. We may also change or discontinue the Service. Where required, we will provide notice of material changes affecting a paid membership.
12. Disclaimers
The Service is provided “as is” and “as available” to the maximum extent permitted by law. We do not guarantee uninterrupted availability or that records, reminders, dates, calculations, or Marlow responses will be complete, accurate, current, or suitable for a particular decision.
You remain responsible for the condition, maintenance, operation, insurance, legal compliance, and safe use of your boat. Nothing in these Terms limits consumer rights that cannot lawfully be waived.
13. Limitation of Liability
To the maximum extent permitted by law, BOATERA and its owners, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, records, goodwill, or use arising from the Service.
Our total aggregate liability for claims related to the Service will not exceed the amount you paid BOATERA during the 12 months before the event giving rise to the claim, except where applicable law does not allow that limitation.
14. Governing Law and Changes to These Terms
These Terms are governed by the laws of the State of New Mexico, United States, except where mandatory consumer law requires otherwise. Disputes that cannot be resolved informally will be handled in the state or federal courts located in New Mexico.
We may update these Terms. We will post the revised version and update the date above. If a change materially affects your rights or paid membership, we will provide additional notice where required.
